Gestational Surrogacy is permitted in the Australian Capital Territory , and New South Wales, while remaining illegal in South Australia and Queensland. Apparently, even governmental officials travel interstate to participate in gestational surrogacy only to face legal issues when they return home with their child. Victoria, Western Australia, South Australia, Tasmania and Queensland have announced reviews of the laws relating to surrogacy.
Generally speaking, the genetic parents are deemed the legal parents under South Australian law. Gay couples have been specifically denied access to surrogacy throughout the country.
Egg donation is permitted, but donations are generally uncompensated. There are current discussions regarding compensation so as to increase the donor pool size. Pre-embryos are permitted to be cryo-preserved for up to 5 years after which they will be destroyed.
